These Terms and Conditions (“Terms”) govern your use of solidgroundstl.com (the “Site”) and any communications you receive from Solid Ground LLC, doing business as Solid Ground Construction and Design (“Solid Ground,” “we,” “us,” or “our”), including email and text messages.
By using the Site, submitting a form, or opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use the Site.

We design and build custom decks, screen enclosures, patio covers, pergolas, outdoor kitchens, and related outdoor living structures for residential customers in the greater St. Louis and St. Charles, Missouri region.
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Submit false, misleading, or fraudulent information through any form
- Submit a phone number you are not authorized to use
- Attempt to gain unauthorized access to the Site, our servers, or any connected system
- Use automated tools to scrape, harvest, or overload the Site
- Upload malicious code or interfere with the Site’s operation
- Copy or reuse Site content in violation of Section 9
We may suspend or block access to the Site at our discretion if these Terms are violated.
3. Estimates, Quotes, and Proposals
Any pricing shown on the Site, discussed by phone, or provided in a preliminary estimate is an approximation for budgeting purposes only. It is not an offer and is not binding. Final pricing depends on a site visit, measurements, site conditions, material selections, engineering, and permit requirements.
Requesting a consultation does not create a contract. A binding agreement is formed only when both parties sign a written construction contract.
4. Construction Contracts Take Precedence
These Terms govern the Site and our marketing communications. The scope of work, price, payment schedule, timeline, change orders, and warranty for any project are governed exclusively by the signed written construction contract between you and Solid Ground. Where these Terms and a signed contract conflict, the signed contract controls.
5. SMS and Text Messaging Terms
By providing your mobile number and giving express written consent, you agree to receive text messages from Solid Ground LLC at that number. The following terms apply to our SMS program.
5.1 Program Description
Solid Ground sends text messages relating to appointment reminders and confirmations, quote and estimate follow-ups, project status and scheduling updates, crew arrival notices, customer care responses, and, where separately opted in, promotional offers and seasonal specials.
5.2 Consent Is Not a Condition of Purchase
Consent to receive automated text messages is not a condition of purchasing any goods or services from Solid Ground. You may decline text messages and still receive a quote and hire us.
5.3 Message Frequency
Message frequency varies depending on your project stage and your interactions with us.
5.4 Message and Data Rates
Message and data rates may apply. Solid Ground does not charge for text messages. Charges from your mobile carrier are your responsibility. Contact your carrier for details about your plan.
5.5 Opting Out
Reply STOP to any message to cancel. After you send STOP, we will send one confirmation message and will not send further text messages unless you opt in again. You may also opt out by calling (636) 262-5157 or emailing tara@solidgroundstl.com.

5.7 Supported Carriers
Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, and others. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless service provider and is not guaranteed.
5.8 Changing or Deactivating Your Number
You agree to notify us if you change or deactivate the mobile number you gave us, so that messages intended for you are not sent to someone else.
5.9 Privacy
Mobile numbers and SMS consent data are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
6. Email Communications
When you submit a form or become a customer, we may email you about your inquiry, your project, and, if you opted in, our news and offers. You can unsubscribe from marketing emails at any time using the link in any email. Transactional emails about an active project will continue.
7. Payments
Deposits, progress payments, and final payment terms are set out in your signed construction contract. Payments made through third-party processors are subject to those processors’ terms. Returned payments and late payments may incur fees as stated in your contract.
8. Warranties
Workmanship and material warranties are described in your signed contract and on our Warranties and Guarantee page. Manufacturer warranties on decking, railing, and other products are provided by the manufacturer, not by Solid Ground, and are subject to the manufacturer’s own terms and registration requirements.
Nothing on the Site creates a warranty. Information on the Site is provided for general guidance and may not reflect current product availability, pricing, or code requirements.
9. Intellectual Property
All content on the Site, including text, photographs, project galleries, designs, drawings, logos, and the Solid Ground name and marks, is owned by Solid Ground LLC or licensed to us and is protected by copyright and trademark law. You may view and print Site content for personal, non-commercial use. You may not copy, republish, sell, or use Site content for any commercial purpose without our prior written permission.
10. Project Photography and Media
We may photograph or video completed projects for our portfolio, website, and marketing. We do not publish customer names or street addresses without permission. If you prefer that your project not be used in our marketing, tell us in writing and we will honor that request.
11. Third-Party Links and Financing
The Site links to third-party websites, including manufacturers, review platforms, and financing partners. We do not control those sites and are not responsible for their content, products, terms, or privacy practices. Financing is provided by independent lenders under their own terms, approval criteria, and rates. Solid Ground is not a lender and does not approve or decline financing applications.
12. Disclaimers
The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that any information on the Site is complete or current.
13. Limitation of Liability
To the fullest extent permitted by Missouri law, Solid Ground LLC and its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from any communications sent under these Terms, including lost profits or lost data, even if we were advised of the possibility of such damages.
Our total liability arising out of the Site or these Terms will not exceed one hundred dollars ($100). This limitation does not apply to obligations under a signed construction contract, which are governed by that contract, and does not limit any liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless Solid Ground LLC from any claims, damages, or expenses, including reasonable attorney fees, arising from your misuse of the Site, your violation of these Terms, or your submission of a phone number you were not authorized to provide.
15. Complaints and Dispute Resolution
15.1 How to File a Complaint

Please include your name, the project address, your preferred contact method, and a description of the issue.
15.2 Our Response Process
- We acknowledge every complaint within 3 business days.
- An owner or project manager reviews the complaint and contacts you to discuss it.
- We provide a written resolution or a plan of action within 15 business days. If an inspection or supplier response is needed, we will tell you the revised timeline.
15.3 Good-Faith Resolution First
Before starting any legal action, you agree to give us written notice of the dispute and 30 days to resolve it in good faith. Most issues are resolved at this stage.
15.4 Unresolved Disputes
If a dispute is not resolved, it will be handled as provided in your signed construction contract. Where no contract applies, disputes will be brought in the state or federal courts located in St. Charles County, Missouri, and both parties consent to the jurisdiction of those courts.
15.5 External Complaint Channels
You may also contact the Missouri Attorney General’s Consumer Protection Division at ago.mo.gov or 1-800-392-8222, or the Better Business Bureau of Eastern and Southwest Missouri and Southern Illinois at bbb.org. Filing with an external body does not replace your obligation under Section 15.3 to give us notice first.
16. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law rules.
17. Changes to These Terms
We may update these Terms at any time. The “Last Updated” date at the top of this page shows the current version. Continued use of the Site after an update means you accept the revised Terms. Material changes to our SMS program will be communicated to active subscribers.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and Solid Ground LLC regarding the Site and our marketing communications. They do not modify any signed construction contract.
